How much do you have to change a name to avoid copyright and trademarks?

I am wondering how much do you have to change something to avoid having problems with copyright and trademarks? For instance, can I use the same name as a business as long as I don't spell it the same way (thus it would be different- right)? how much do I have to alter it?
